EXERCISE OF THE RIGHT OF REFUSAL, WRONG DELIVERY AND RETURN AND EXCHANGE OF DEFECTIVE ITEM 

1. RIGHTS OF REFUSAL

The buyer, in accordance with the Consumer Rights Protection Law of the Republic of Latvia and Rules of the Ministry of Justice of the Republic of Latvia No. 255, may use the right of withdrawal and within 14 calendar days refuse the concluded distance contract and the delivered Goods.

1.1. Restrictions on the exercise of the right of withdrawal

1.1.2. Clause 22 of the Regulations of the Cabinet of Ministers of May 20, 2014 No. 255 "Regulations on distance contracts" states that the consumer cannot use the right of withdrawal if:

(1) The buyer has opened the packaging of the product, which cannot be returned due to health and hygiene reasons (hygiene products, cosmetics, etc.);

(2) The packaging of the product has been opened and/or damaged (dirty, scratched, torn, wrinkled, damaged labels, etc., the validity period of which will be shortened from the moment of its opening);

(3) The deadline for exercising the right of withdrawal specified in the legislation has expired for the product;

(4) Due to its characteristics, the product is irreversibly mixed with other things after delivery.

1.2. Procedure for using the right of refusal.

1.2.1. The Buyer informs the Seller in writing about exercising the right of withdrawal within 14 days from the moment of receiving the ordered Goods by sending a completed withdrawal form, which can be obtained on the Internet at the following address: http://likumi.lv/ta/id/266462-noteikumi-par-distances-ligumu The completed form is sent by the Buyer to the Seller to the e-mail address naiskonsultants@gmail.com or to the Seller's address Ernesta Birznieka - Upīša street 20A, Riga, LV-1050. The deadline has been met if the Buyer sends the withdrawal form to the Seller before the expiry of the right of withdrawal.

1.2.2.  The Buyer sends the product back to the seller or service provider or hands it over to the Seller without undue delay, but no later than within 14 days after sending the cancellation form to the Seller on exercising the right of withdrawal. The deadline is met if the product is sent back before the 14-day deadline.

1.2.3.  The Seller reimburses the Buyer for the payments received from the Buyer, including delivery costs (except for additional costs incurred due to the Buyer choosing a delivery method other than the cheapest standard delivery method offered by the Seller) within 14 days from the day the Seller has received a completed Cancellation form from the Buyer (decision to withdraw from the contract) and when the Seller has received back the Goods that the Buyer refuses. The purchase fee is refunded with the type of payment method used in the original transaction, unless otherwise agreed between the Buyer and the Seller. 

1.2.4. If the purchase of the returned Goods ensured that the Buyer received a gift product (e.g. a gift for the purchase amount or the purchase of a certain product), the Buyer returns the received gift together with the Product to the Seller. If the Buyer has not returned the gift product, then the value of this product is deducted from the refundable purchase price of the returned Goods.

1.2.5. The Seller has the right to withhold the payment until he has received the Goods from the Buyer, which the Buyer wants to refuse, as well as not to make a refund if any of the cases specified in point 1.1.2 occur.



2. QUALITY OF GOODS AND RETURN AND EXCHANGE OF WRONGLY DELIVERED GOODS  

2.1. The expiry date of the goods and the manufacturer are indicated on the packaging of the goods.

2.2. When opening the packaging of the Goods, the Buyer is obliged to check whether the Goods specified in the Order have been delivered and whether the ordered type and number of Goods have been delivered, whether the Goods are free of defects or other damages. Also, the Buyer must check the appearance of the Product packaging, whether there is any damage to the Product packaging.

2.3. After receiving the Goods, the Buyer is responsible for maintaining the quality and safety of the Goods during the period of exercising the right of withdrawal. In order to exercise the Right of Withdrawal, the Goods must be unused, undamaged and in their original condition (with unremoved and undamaged labels, untorn protective films, etc.). The Buyer is responsible for the decrease in the value of the Goods if the Goods were used for a purpose for which they were not intended.

2.4. Before using the Goods, the Buyer is obliged to carefully read the information on the Product's label or the Product's packaging, as well as familiarize himself with the Product's instructions for use. If the Buyer has not followed the instructions for use of the Product, the Buyer loses the right of Refusal, loses the right to file a Consumer's claim or use the Product manufacturer's warranty.

2.5. If, due to the fault of the Seller, the Buyer has received the wrong Product in the shipment (a product or volume that does not match the order), the costs of returning and exchanging the Goods shall be borne by the Seller, provided that the Buyer has followed the procedures for receiving the Goods stipulated in these regulations and the Goods to be returned have not been opened, used or damaged. The Seller provides exchange of the Product within 3 working days, from the moment of returning the erroneously sent Product to the Seller's store. 

2.6. If the Product received by the Buyer was damaged during delivery, the Buyer is obliged to send the Seller a notification (with a description of the damage, order number, name of the Product) and attach a photograph of the damaged postal package and the Product. The Seller provides the product exchange within 3 working days.
